Incompatibility with TPD
European Directive 2014/40/EU (TPD) explicitly prohibits adding tobacco to herbal products for smoking. They are distinct and incompatible legal categories.
Free Movement (Art. 34 TFEU)
The exclusive channeling through tobacconists of a legal agricultural product (Kanavape ruling) raises questions about the free movement of goods in the EU.
Precedent Vaping Italy
The EU Court of Justice has already annulled similar attempts in Italy to monopolize tobacco-related products that did not contain tobacco.
